The steps to buying your property

Reports, surveys and noting interest

Once you have identified a property that you are interested in, our team of solicitors and paralegals can support you through the steps required to make your prospective purchase a reality. We will contact the seller's representatives to note your interest in the property and obtain a copy of the seller’s home report. . Noting interest will allow us to be kept informed of any changes to the status of the property, for example, if there is a closing date set. The seller’s home report (or homebuyers report) contains important details and information relating to the property We can also instruct experts to carry out additional surveys on the property to identify any potential issues (this can be done either prior to submitting an offer or after an offer has been submitted and accepted so long as the offer has made this a condition). With many years of experience and a comprehensive knowledge of the local area, our team can advise you on the contents of these reports and to help you make a decision that is right for you and structure the right kind of offer you wish to make.

Making an offer

If you are happy to proceed to make an offer for a property, you should first confirm that you have the finance in place. If you will be funding the purchase by way of a mortgage you should find out if you are able to obtain a mortgage to buy the property, this is usually referred to as having a mortgage promise or a decision in principal from your chosen lender. Our solicitors and paralegals can provide guidance on how to obtain a mortgage promise. When you are in a position to make an offer we will support you and provide advice to you, prepare the offer on your behalf and submit this to the selling agent.

 

If the offer is successful

If an offer you have submitted is acceptable to the seller, the seller’s agent will initially communicate this verbally and this will be followed by a written acceptance. This starts the legal process of entering into missives with a view to concluding a contract. The “missives” are the formal letters which make up the “contract”. Once all conditions have been agreed the missives can be concluded and it is at that time the contract becomes binding.

 

Completing the purchase

Once the conveyancing has been completed, missives have been concluded and you have provided us with all that we need from you we will then work towards making sure that all funds are collected (from you and any lender (if applicable)) and the price is transferred to the seller’s solicitor, that the deeds to the property are delivered to us and that you receive the keys to the property on the scheduled completion date (date of entry). Following completion of your purchase we shall attend to registration of the title and any security (if applicable) at Registers of Scotland.
