Adults with Incapacity

If a Power of Attorney is not granted at the appropriate time, then if someone becomes incapable of managing their own affairs, it is sometimes necessary for an application to be made under the Adults with Incapacity (Scotland) Act 2000.

What this means is that someone (usually a close relative) applies to the court for authority to become financial or welfare guardian or to obtain authority to take a specific action such as selling a house or operating a bank account. This is usually a much more expensive and time consuming option than granting a Power of Attorney in advance.

All guardians appointed by the court can obtain assistance from, and are also regulated by, the Office of the Public Guardian in Falkirk.
